Can a Convenience Store, Supermarket or Newsagent hold Wine Retailers On (Wine On) Licence?
 
 
Introduction
 
Prior to 2000, the Revenue Commissioners issued Wine Retailers On Licences (Wine On) in respect of the above types of premises as there was no alternative Licence available for the sale of Wine Off the premises short of a Full Off Licence.
 
The 2000 Intoxicating Liquor Act allowed any occupier of such premises to apply to the Revenue Commissioners for a Wine Retailers Off Licence which specifically allowed for Off sales.
 
The 2008 Intoxicating Liquor Act changed this procedure and required a Wine Retailers Off Licence to be issued on foot of a District Court application.  It should be noted that once the Court grants the Order for the Wine Off Licence, it is renewed annually by Customs and Excise.
 
The Revenue Commissioners have written to the wine retail on licence holders informing them that they must get a court order for a Wine Retailers Off-Licence in order to sell wine for the licensing year September 30th 2011 to September 30th 2012 and each year thereafter. 
 
This in effect means that Revenue may not renew Wine Retailers On Licences held by Supermarkets or Newsagents on September 30th next as they are not the appropriate type of Licence for those premises anyone who holds such a Licence should ensure that they make a Court Application for a Wine Off Licence in sufficient time for the new licensing year bearing in mind the fact that the Courts are closed for the month of August.
